Member Agreement & Liability Waiver

Introduction

We are so excited to welcome you to our Hamptons House!

Please take a moment to read through this Agreement before you arrive. It is here to protect everyone and ensure the experience is everything it should be. This Agreement is entered into by the undersigned member (“Member”) as a condition of attending a BOTELHO gathering. BOTELHO is a brand of Above and Beyond VIP Concierge (“ABCVIP”).

1. Private Gathering Acknowledgment

Member acknowledges that this event is a private social gathering hosted by BOTELHO, a brand of Above and Beyond VIP Concierge (ABCVIP), not a commercial service or ticketed public event. Attendance is by personal invitation only and is extended solely at the discretion of the host.

Knowing the location of this Property does not grant any right to future access. Arrival at the Property at any time other than the designated event window, or without a current, valid invitation, constitutes trespassing. Member agrees never to share the Property address without express written permission from the host.

2. Phone-Free Environment & Device Policy

BOTELHO gatherings are intentionally designed as low-phone spaces. This isn’t about restriction; it’s about creating a true sanctuary where everyone can be present, relaxed, and genuinely connected.

Upon arrival, personal devices will be stored in a provided locker at the entrance. Members may use devices only in the designated Device Area.

  • Store their device upon arrival and use it only in the designated Device Area.
  • Do not record audio, video, or photographs in any non-designated area.
  • Respect that other members have consented to a private, camera-free experience.

3. No-Politics Policy

Discussions of any political nature are strictly prohibited at all BOTELHO events.

  • Political discussion will be kindly redirected.
  • Repeated or disruptive political engagement may result in removal without refund or recourse.
  • This policy applies equally to all members.

4. Photo & Media Consent

By attending, Member consents to being photographed and filmed by the BOTELHO team.

  • Members will receive access to a curated shared folder of photos and short video clips.
  • No image or video will be published without prior approval.
  • No personally identifiable information will be published without separate written consent.

Member may opt out of media use by notifying the host in writing prior to the event.

5. Food, Allergies & Dietary Restrictions

Our gatherings feature home-cooked meals prepared with care by the founder and host of BOTELHO.

  • Member is responsible for disclosing allergies or dietary restrictions at least 72 hours before the event.
  • BOTELHO will make reasonable efforts to accommodate restrictions but cannot guarantee an allergen-free environment.
  • Members with severe allergies are encouraged to carry their own epinephrine auto-injector.
  • BOTELHO and its host(s) are released from liability arising from undisclosed allergies or dietary conditions.

6. Transportation Policy: No On-Site Parking

There is absolutely no personal vehicle parking available at or near the Property. Member agrees to arrive and depart via:

  • Rideshare (Uber, Lyft, or similar)
  • Car service or hired transportation
  • Partner hotel shuttle

7. Assumption of Risk

Member voluntarily assumes all risks associated with attending a private residential gathering, including:

  • Swimming pool and hot tub use
  • Slippery surfaces
  • Stairs, decks, and outdoor terrain
  • Grilling or cooking equipment
  • Weather-related hazards
  • Alcohol consumption

8. Release of Liability

To the fullest extent permitted by law, Member releases BOTELHO, Above and Beyond VIP Concierge, its founder, employees, contractors, the renter of the Property, and the property owner from any claims arising out of attendance at the event.

9. Property Damage: Member Financial Responsibility

Member agrees to be financially responsible for any damage they cause to the Property, furnishings, fixtures, landscaping, equipment, or other items belonging to the Property or host.

10. Pool & Hot Tub Safety

  • No diving in shallow areas.
  • No running or reckless behavior near the pool.
  • No glass in the pool area.
  • No use while intoxicated.
  • No unsupervised use by minors.
  • Observe all posted pool rules.

11. General Conduct

  • Treat fellow members, staff, and the Property with care and respect.
  • Comply with all requests from the host or BOTELHO team.
  • Observe all local ordinances, including noise restrictions.
  • Do not engage in reckless, threatening, or disruptive behavior.

12. Indemnification

Member agrees to indemnify, defend, and hold harmless BOTELHO, Above and Beyond VIP Concierge, its founder, employees, agents, the renter, and the property owner from claims, damages, liabilities, costs, and expenses arising from Member's conduct.

13. Medical Emergency

No medical supervision is provided. In the event of a medical emergency, Member consents to the host contacting emergency services (911) on their behalf.

14. Member Acknowledgment & Signature

  • Member has read this Agreement in full.
  • Member voluntarily agrees to all terms.
  • Member is at least 21 years of age.
  • Member understands this is a legally binding document.
